Judicial practice in the interests of the agro-industry is formed in the Sverdlovsk region. The Sverdlovsk Arbitration Court satisfied the claim of the Sverdlovskaya Poultry Farm to the Federal Service for the Supervision of Nature Management on the repeal of the prescription to develop a waste passport for chicken manure. The decision has not entered into force.
The case file reports that the Sverdlovskaya Poultry Farm uses poultry waste for the production of organic fertilizers, which it exports to its own fields. Since the subject matter of the prescription is the storage of waste, and in fact the litter is processed into fertilizer, the court decided that "the conclusions [of the Federal Service] were made on the basis of a visual inspection without laboratory research, that is, they were conjectural." Sverdlovsk Arbitration Court refused to take into account judicial practice on this issue, since the conclusion about the presence of waste and its storage can only be done with the help of expertise, which is not in this particular dispute.
Since 2016, agricultural enterprises are obliged to license waste disposal. The procedure for obtaining a permit (state environmental review) is a long and expensive one. The complexity of the procedures was the reason that no agricultural company in the region at the end of last year did not issue an examination. Enterprises avoid problems with licensing, processing livestock and poultry farming as products. They receive certificates for five years, confirming that litter and manure are their main product, and meat and eggs are byproducts. Since January 1, 2019, all agro enterprises have become factories of the first danger class (the most toxic) and must receive a comprehensive environmental permit, which requires the same state expertise.
